You must be able to demonstrate extraordinary ability in the sciences, arts, education, business, or athletics through sustained national or international acclaim. Additionally, the beneficiary must intend to continue working in their field of expertise, and their entry must prospectively substantially benefit the United States.

It is important to note for this type of petition that merely meeting the regulatory criteria is not necessarily enough to grant this petition, as officers will also make a determination on its merits on the quality of the evidence submitted and determine if the beneficiary has sustained national or international acclaim and their achievements were recognized by those in their respective fields. In other words, that the beneficiary has reached near the top of their industry.
